Welcome to Stephanie Kurtyka Art. The StephanieKurtykaArt.com website (the "Site") is comprised of various web pages operated by Stephanie Kurtyka Art. StephanieKurtykaArt.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of StephanieKurtykaArt.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.

RIGHTS TO ARTWORK AND IMAGES

All artwork, images, and graphics are the sole property of Stephanie Kurtyka and may not be used by any third party without written permission.  

Copying or reproducing artwork created by Stephanie Kurtyka (as seen on StephanieKurtykaArt.com, or elsewhere) is strictly prohibited without written permission from the artist.  

• Stephanie Kurtyka Art retains all rights to all artwork until it has been purchased by a private or public collector at which time the collector receives the right to display the artwork in their home or business, but the artwork may not be resold or reproduced without my written permission. The collector or buyer may not reproduce the artwork in any way without written permission.

• Stephanie Kurtyka Art retains all rights to the image of all artwork including the rights to the image of sold & commissioned original paintings.   

• Stephanie Kurtyka Art retains the right to make REPRODUCTIONS OF ANY AND ALL ARTWORK CREATED BY Stephanie Kurtyka UNLESS THE COLLECTOR HAS PURCHASED THE FULL OR PARTIAL RIGHTS TO THE ARTWORK in addition to purchasing the original painting.

• If you own an original painting and would like to discuss purchasing further rights, displaying the work in a public space, or nullify my right to reproduce, please contact stephaniekurtykaart@gmail.com

• If the artwork ends up being reproduced in a magazine or other media I only ask for credit.

COLLECTORS OF REPRODUCTIONS HAVE THE RIGHT TO DISPLAY THE ARTWORK IN THEIR HOME OR BUSINESS BUT RETAIN NO OTHER RIGHTS TO THE ARTWORK. 

Any image of the interior which includes the artwork in a 3rd party publication (such as social media, magazine, or book) must come with attribution (artwork title, artists name).

All other uses must be agreed to in advance in writing.

Electronic Communications

Visiting StephanieKurtykaArt.com or sending emails to Stephanie Kurtyka Art constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

Your Account

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Stephanie Kurtyka Art is not responsible for third party access to your account that results from theft or misappropriation of your account. Stephanie Kurtyka Art and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

Stephanie Kurtyka Art does not knowingly collect, either online or offline, personal information from persons under the age of eighteen. If you are under 18, you may use StephanieKurtykaArt.com only with permission of a parent or guardian. If you are under the age of 18, please do not submit any Personal Information through the Website and Services. If you have reason to believe that a child under the age of 18 has provided Personal Information to us through the Website and Services, please contact us to request that we delete that child’s Personal Information from our Services.

We encourage parents and legal guardians to monitor children’s Internet usage and to help enforce this Policy by instructing their children never to provide Personal Information through the Website and Services without their permission. We also ask that all parents and legal guardians overseeing the care of children take the necessary precautions to ensure that their children are instructed to never give out Personal Information when online without their permission.

International Users

Stephanie Kurtyka Art (and StephanieKurtykaArt.com) is controlled, operated and administered by Stephanie Kurtyka Art from our studio within the USA. If you access the site from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Stephanie Kurtyka Art Content accessed through StephanieKurtykaArt.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Liability Disclaimer

This site isn’t perfect. Nor are we, the studio team or Stephanie Kurtyka. There may be inaccuracies, errors, typographical mistakes, and all sorts of messes on this website and in the studio content in general. We reserve the right to change all of it — the whole website. Every word.

Stephanie Kurtyka Art shall not be held liable for any direct, indirect, incidental, special, or consequential damages caused by this website, squarespace.com, or any third party. If you are not happy with this website, you don’t have to use it.

SECURITY

Payment information is not retained by Stephanie Kurtyka Art and we take precautions to protect your information during this process. When you submit sensitive information via the website, your information is protected both online and offline.

Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way through a Payment Processing System (Stripe or Paypal, depending on our preference at checkout).

Cancellation/Refund Policy

Original Art: All original art sales are final. Cancellations, exchanges and refunds are not available.

Art Prints, Reproductions, and non-original products: All art print, reproduction, and non-original product sales are final. We are not able to offer refunds or returns as all prints, reproductions, non-original products are “made to order”. We do allow exchanges only for the “Unframed” print option within 7 calendar days from the date of delivery for prints in undamaged condition. Buyer is responsible for all shipping charges associated with an exchange, playing any difference in price, and will be charged a 5% restocking fee based on the total price of the original prints(s), reproduction(s), non-original product(s) being exchanged. Art Print, Reproduction, Non-original Product orders can only be cancelled if the print, reproduction, non-original products has not been printed/created yet, as all orders are “made to order”. Prints, reproductions, non-original products are sometimes printed/created immediately so there is no guarantee you will be able to cancel your print, reproduction, non-original product order. Due to costs associated with every order, regardless if it has been printed/created, a 5% cancellation fee based on the total cost of your cancelled order will be deducted from your refund.

Lost, Damaged, or Stolen Art Prints, Reproductions, and non-original products: Any lost, damaged, or stolen artwork must be reported within 14 days of delivery. When reporting damage you must share your order number, photos of the damage, and photos of the exterior and interior view of the packaging that the artwork arrived in. Damaged, lost or stolen prints, reproductions, non-original products will be replaced. No refunds will be given.

Seconds Sale or any other sale: All sales are final. Cancellations, exchanges and refunds are not available.

Framed Artwork Policies: Frames and framed artwork are currently only available in the domestic U.S. All frames and framed artwork are final sale. Refunds, returns and exchanges are unavailable as all frames are made to order. Framed artwork orders can only be cancelled if we have not yet submitted your frame order and/or artwork to our framer for fulfillment. Framed artwork orders are sometimes sent to our framers immediately so there is no guarantee you will be able to cancel or make changes to your frame(s) and/or artwork(s) order once you place your order. Due to the costs associated with every order, regardless if it has been fulfilled, you will be charged a 5% cancellation fee based on the total cost of your framed artwork order. We are unable to accept any returns for frames. All stretched, frames and framed print sales are final sale.

Lost, Damaged or Stolen Frames, Framed Artwork: Any damaged, lost, or stolen frames and/or framed artwork must be reported within 14 days of delivery. When reporting damage you must share your order number, photos of the damage, and photos of the exterior and interior view of the packaging that the artwork/frame arrived in. Damaged, lost, or stolen frames and/or framed artwork will be replaced. No refunds will be given.

Damaged Frame Disposal Policy: In the instance that a replacement frame is issued, our framer requires that damaged frames be disposed of by the recipient and to provide photographic evidence of doing so.

Shipping and Processing Policies

Original Art Order Processing Time: This refers to the time it takes for us to receive your order and prepare it for shipping. This typically falls in the range of 8-14 business days, depending on how busy we are. Estimated shipping times at checkout are in addition to our order processing time.

Print, Reproduction, Non-original Product Order Processing Time: This refers to the time it takes for us to receive your order and print / prepare it for shipping. This typically falls in the range of 8-14 business days, depending on how busy we are. Estimated shipping times at checkout are in addition to our order processing time.

Framed Artwork Order Processing Time: Please allow about 2 weeks for your framed artwork to ship. This allows for print order processing time and custom framing time.

Domestic Shipping Policy: hipping is calculated and charged at checkout with a variety of services to choose from for shipping your prints. All "original artwork" will be sent USPS or an equivalent service and insured.

International Shipping Policy: For International Shipping, please contact Stephanie Kurtyka Art at StephanieKurtykaArt@gmail.com for an International Shipping charges quote. All international shipping includes insurance. Buyer is responsible for all duties and taxes that may be imposed on them by their country. This is an additional cost to your order for you to expect when the package reaches your country. Orders that are rejected by the buyer upon delivery will not be refunded. Please be aware that international shipping times can be unpredictable and sometimes lengthy. We are unable to process refunds or resend potentially lost orders until packages have been stuck in transit for the timeframe specified by the carrier to file a claim.

Incorrect Shipping Information: The buyer is responsible for providing the correct shipping information. Orders will not be refunded for lost, mis-delivered, undelivered, or returned orders due to the buyer providing incorrect shipping information. Orders will not be refunded if the order(s) is lost, delivered to the wrong address, or returned by the carrier due to the buyer providing incorrect shipping information. The buyer will be responsible for all re-shipping costs to the correct address, as well as a 50% re-print charge based on the value of the print to be re-printed if the original order is lost due to giving us incorrect shipping information.
